Terms of Service

1. Acceptance of Terms
By creating an account on Speassy (speassy.com or the Speassy mobile application, collectively the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our Cookie Policy.
If you do not agree to these Terms, you must not create an account or use the Platform.

Full legal entity details including company name, registered address, NIP and KRS numbers will be published in these Terms upon company incorporation. To contact the operator directly regarding these Terms, email support@speassy.com.
3. Description of the Platform
Speassy is a free online language learning platform. In its current version, Speassy provides two core features:
- Live audio rooms: group voice sessions where participants practise speaking a target language in real time. All registered users aged 16 and over have full unrestricted access to audio rooms.
- 1-on-1 messaging: text-based conversation between users for language exchange, peer corrections, and practice.
Speassy is currently free of charge. There are no paid features, no teacher marketplace, no lessons, and no subscription plans at this time. Future features may be introduced in later versions of the Platform. These Terms will be updated with at least 14 days notice before any such features are launched.
4. Eligibility and Account Registration
4.1 Minimum Age
You must be 16 years of age or older to register and use Speassy. By providing your full date of birth (day, month, year) at registration, you confirm that you meet this requirement.
If the date of birth you enter indicates that you are under 16, registration is blocked and no account is created. If you provide a false date of birth to circumvent this restriction, you are solely responsible for any legal consequences. Speassy reserves the right to terminate any account found to belong to a user under 16 and delete all associated data immediately.
4.2 Account Registration
To use Speassy you must create an account. You agree to:
- Provide accurate, current, and complete information during registration including your real name, email address, and full date of birth.
- Keep your account information up to date.
- Keep your password confidential and not share it with anyone.
- Notify us immediately at support@speassy.com if you suspect unauthorised access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Acceptable Use Policy
5.1 Permitted Use
You may use Speassy only for its intended purpose: language learning and language exchange through live audio rooms and 1-on-1 messaging. All use must comply with applicable Polish and EU law.
5.2 Prohibited Conduct
You must not use Speassy to:
- Post, transmit, or share content that is illegal, harmful, defamatory, obscene, hateful, discriminatory, or sexually explicit.
- Harass, threaten, stalk, or abuse other users in any feature of the Platform including audio rooms and messaging.
- Impersonate another person or entity, or misrepresent your identity or age.
- Use the Platform for any commercial purpose including soliciting paid services from other users.
- Scrape, crawl, or extract data from the Platform by automated means without prior written consent from Speassy.
- Circumvent any technical measures, security controls, or access restrictions including the age verification at registration.
- Upload or transmit viruses, malware, or any other harmful code.
- Spam other users with unsolicited messages or promotions.
- Share personal contact details such as phone numbers, email addresses, or social media handles in public audio rooms to move conversations off-platform.
- Use the Platform in any way that endangers, exploits, or exposes other users to inappropriate content or contact.
- Violate any applicable Polish, EU, or international law.
5.3 Audio Room Rules
Live audio rooms are open to all registered users aged 16 and over. When participating you must not:
- Use language or engage in behaviour that is abusive, sexual, threatening, or discriminatory.
- Record any session without the explicit consent of all other participants in the room.
- Engage in conduct that could constitute grooming, solicitation, or exploitation of other users.
Every audio room contains a clearly visible report button. Use it to report any conduct that violates these rules. Speassy reviews all reports and will take action including account suspension or termination where warranted.
5.4 Messaging Rules
The 1-on-1 messaging feature is provided for language exchange and practice. You must not use messaging to send unsolicited commercial messages, harass other users, or share content that violates Section 5.2.
5.5 Content Moderation and Removal
Speassy reserves the right to remove any content that violates these Terms or applicable law. In accordance with the EU Digital Services Act (DSA), where we remove your content or restrict your account, we will notify you of the reason without undue delay and provide an opportunity to appeal via our internal complaints mechanism described in Section 11.
6. User-Generated Content
6.1 Ownership
You retain ownership of all content you create and share on Speassy, including messages and profile information.
6.2 Licence Granted to Speassy
By submitting content to Speassy, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, reproduce, and transmit your content solely for the purpose of operating and providing the Platform. This licence ends when you delete your content or your account, subject to legal retention obligations.
We will never sell your content to third parties or use it for advertising without your explicit consent.
6.3 Content Standards
All content you submit must:
- Be your own original content or content you have the right to share.
- Not infringe any third-party intellectual property rights.
- Not contain personal data of third parties without their consent.
- Comply with the Acceptable Use Policy in Section 5.
6.4 Audio Sessions
Live audio room sessions are transmitted in real time. Speassy does not record or store audio room sessions. By participating in a live audio room, you consent to other participants in that room hearing your voice. You must not record sessions yourself without the explicit consent of all participants.
7. Intellectual Property
All elements of the Speassy Platform including the software, design, logo, trademarks, and all content produced by Speassy are the exclusive intellectual property of Speassy or its licensors, protected by Polish and EU copyright and trademark law. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
If you submit feedback, suggestions, or ideas about Speassy, you grant us the right to use them freely without any obligation or compensation.
8. Privacy and Data Protection
Your use of Speassy is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what personal data we collect including your full date of birth for age verification, how we use and protect it, and your rights under GDPR.
9. Cost and Payments
Speassy is currently entirely free of charge. There are no subscription plans, no in-app purchases, and no payments of any kind. You will never be charged without explicit notice and updated Terms being provided at least 14 days in advance.
10. Service Availability and Disclaimers
Speassy is provided “as is” and “as available”. We make reasonable efforts to keep the Platform operational but do not guarantee:
- Uninterrupted or error-free access.
- That content provided by other users is accurate or appropriate.
- That the Platform will meet your specific language learning objectives.
Under Polish consumer law (Ustawa o prawach konsumenta) and EU Directive 2019/770 on digital content and services, consumers retain statutory rights regarding digital services that cannot be excluded by contract. Nothing in these Terms limits your statutory consumer rights.
11. Complaints, Appeals and Dispute Resolution
11.1 Internal Complaint Mechanism
In accordance with the EU Digital Services Act, Speassy provides a free internal complaints mechanism. If your content was removed, your account restricted, or you disagree with any moderation decision, email support@speassy.com with the subject line “COMPLAINT” and a brief description. We will acknowledge your complaint within 7 days and provide a substantive response within 14 days.
11.2 Out-of-Court Dispute Resolution
If your complaint is not resolved to your satisfaction, you may use:

11.3 Governing Law and Jurisdiction
These Terms are governed by Polish law. Any disputes that cannot be resolved by the mechanisms above will be submitted to the competent courts in Poland. For consumer users within the EU, mandatory consumer protection provisions of your country of residence also apply.
12. Account Termination
12.1 Termination by You
You may delete your account at any time via account settings or by emailing support@speassy.com. Upon deletion, your personal data will be processed in accordance with our Privacy Policy. Account data is deleted within 30 days, subject to legal retention obligations.
12.2 Termination by Speassy
We may suspend or terminate your account if you violate these Terms, engage in conduct harmful to other users, provide false information at registration including a false date of birth, or use the Platform for fraudulent or illegal purposes. In cases of serious or illegal conduct, suspension may be immediate and without prior notice. You will be notified of the reason and provided an opportunity to appeal except where prohibited by law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Speassy and its operator shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform, content created by other users, or technical failures of third-party services. Nothing in this section limits your statutory consumer rights under Polish or EU law.
14. Changes to These Terms
We may update these Terms when we incorporate a company, introduce new features or paid plans, or when legal requirements change. We will:
- Notify registered users by email at least 14 days before material changes take effect.
- Display a prominent notice on the Platform.
- Update the effective date at the top of this document.
Continued use after the effective date constitutes acceptance of the updated Terms.
15. General Provisions
- Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Speassy regarding the Platform.
- Severability: If any provision is found unlawful or unenforceable, the remaining provisions remain in full force.
- No waiver: Failure to enforce any provision does not constitute a waiver of our rights.
- Assignment: You may not assign your rights under these Terms to any third party.
- Language: These Terms are provided in English. If translated, the English version prevails in case of conflict.
